Distracted Driving

In a local report of a current crackdown by police on texting and calling on a phone while driving (which I totally support) it was stated that “unless there is a witness or the driver admits to using a phone to text or dial while driving” there is nothing the police can do to prove distracted driving was the cause of an accident.

I don’t understand. A traffic investigation should easily reveal when the accident happened usually within minutes. Since all text messages and phone calls leave a record when they were placed would not a simple check of the driver’s phone show they were using it just before the accident?

Just wondering.
